Chaffed Emus Pty Ltd trading as Elders Real Estate Yeppoon (we, us or our) has adopted this Privacy Policy to ensure that we collect, hold, use and disclose personal information in accordance with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth) (the Act).
We will maintain and regularly review this Policy and are committed to complying with the APPs and the Act. This Policy is available on our website and a free printed copy can be requested from our office at any time.
Elders Real Estate Yeppoon is an independently owned and operated real estate business, licensed to use the Elders trademark and brand under a franchise arrangement with Elders Limited. We are a separate legal entity (Chaffed Emus Pty Ltd ABN 79 612 869 691) and are solely responsible for the collection, handling, storage and disclosure of personal information described in this Policy. This Policy applies to Elders Real Estate Yeppoon only and does not extend to, and should not be read as, the privacy policy of Elders Limited or any other Elders franchised office.
Policy Objectives
It is the objective of this Policy to detail how we intend to meet our obligations under the Act in the course of providing real estate sales and appraisal services.
Policy Scope
This Policy applies to all personal information collected by Elders Real Estate Yeppoon in the course of our business, including through our office, website, telephone, email, listing portals and any related mobile applications.
Definitions
Act means the Privacy Act 1988 (Cth).
APPs means the Australian Privacy Principles set out in Schedule 1 of the Act.
Government related identifier has the same meaning as in the Act.
Personal information has the same meaning as in the Act — broadly, information or an opinion about an identified individual, or an individual who is reasonably identifiable.
Sensitive information has the same meaning as in the Act, and includes information such as health information, and is subject to extra protection under the APPs.
Service Provider means any third party that Elders Real Estate Yeppoon engages to provide services that support our business, such as our CRM, listing, marketing and trust accounting providers.

We generally collect information directly from you, through listing agreements, sale contracts, our website, and other forms you complete when dealing with us.

We may use your personal information to send you information about properties, market updates or services that we reasonably believe may be of interest to you, where you would reasonably expect this or have consented. Every direct marketing communication will include a simple way for you to opt out of receiving further communications, and we will action any such request promptly and at no charge.
Cross-border disclosure of information
Some of our Service Providers, including those supporting our CRM, listing and marketing functions, may store or process personal information on servers located outside Australia. Where this occurs, we take reasonable steps to ensure that any overseas recipient handles your information consistently with the APPs, or that another exception under the Act applies (for example, your consent).
Government related identifiers
We do not generally use government related identifiers (such as a Medicare or driver’s licence number) other than to verify your identity where required by law or as part of a property sale.
Quality of information
We take reasonable steps to ensure the personal information we collect, use and hold is accurate, up to date, complete and relevant to the purpose for which it is used. Where you provide information to us directly, we rely on you to ensure it is accurate.
Security of information
We take reasonable steps to protect personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. This includes secure storage of physical files, access controls on our CRM and IT systems, and requiring our Service Providers to take appropriate security measures.
Where we no longer need personal information, we will take reasonable steps to destroy or de-identify it, unless we are required by law (including trust account, agency or tax record-keeping obligations) to retain it for a set period. For example, we retain copies of sale contracts and trust account records in accordance with applicable real estate legislation.
Access to information
You may request access to the personal information we hold about you by contacting our Privacy Officer using the details below. We may need to verify your identity before providing access. We will generally provide access within a reasonable time, unless an exception under the Act applies (for example, where giving access would be unlawful or would prejudice an enforcement activity). We may charge a reasonable fee for giving access, but not for making the request.
Correction of information
If you believe information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it. We will take reasonable steps to correct the information, and, where we have disclosed it to a third party, to notify that party of the correction, unless it is impracticable or unlawful to do so. If we refuse to correct information, we will provide written reasons and information about how you can complain, and, on request, will attach a statement from you noting your disagreement to the information held.
We will not charge you for making a correction request or for correcting information.
