Policy Statement
Chaffed Emus Pty Ltd trading as Elders Real Estate Yeppoon (we, us or our) has adopted this Privacy Policy to ensure that we collect, hold, use and disclose personal information in accordance with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth) (the Act).

We will maintain and regularly review this Policy and are committed to complying with the APPs and the Act. This Policy is available on our website and a free printed copy can be requested from our office at any time.

Elders Real Estate Yeppoon is an independently owned and operated real estate business, licensed to use the Elders trademark and brand under a franchise arrangement with Elders Limited. We are a separate legal entity (Chaffed Emus Pty Ltd ABN 79 612 869 691) and are solely responsible for the collection, handling, storage and disclosure of personal information described in this Policy. This Policy applies to Elders Real Estate Yeppoon only and does not extend to, and should not be read as, the privacy policy of Elders Limited or any other Elders franchised office.

Policy Objectives
It is the objective of this Policy to detail how we intend to meet our obligations under the Act in the course of providing real estate sales and appraisal services.

Policy Scope
This Policy applies to all personal information collected by Elders Real Estate Yeppoon in the course of our business, including through our office, website, telephone, email, listing portals and any related mobile applications.

Definitions
Act means the Privacy Act 1988 (Cth).
APPs means the Australian Privacy Principles set out in Schedule 1 of the Act.
Government related identifier has the same meaning as in the Act.
Personal information has the same meaning as in the Act — broadly, information or an opinion about an identified individual, or an individual who is reasonably identifiable.
Sensitive information has the same meaning as in the Act, and includes information such as health information, and is subject to extra protection under the APPs.
Service Provider means any third party that Elders Real Estate Yeppoon engages to provide services that support our business, such as our CRM, listing, marketing and trust accounting providers.

PART 1 — HOW WE COLLECT AND USE PERSONAL INFORMATION

Open and transparent management of information
We collect personal information which is reasonably necessary to:

  • list, market and sell residential, commercial and rural property on behalf of vendors;
  • act on behalf of purchasers seeking to buy or appraise property;
  • prepare appraisals, listing agreements, sale contracts and related documentation;
  • facilitate settlement of property sales, including liaising with solicitors, conveyancers and financial institutions;
  • communicate with you about properties, inspections, offers and settlement;
  • comply with our obligations under real estate agency, trust account and anti-money laundering legislation;
  • advertise and promote properties we manage or have listed, including via online listing portals; and
  • improve our website and services.

When you visit our website, our internet service provider or website host may record information such as your IP address, the date, time and duration of your visit, the pages you view and the type of browser you use.

Depending on your dealings with us, we may collect:

  • your name, address, date of birth, and contact details;
  • identification documents (for example, to satisfy identification or trust account requirements in connection with a sale);
  • financial information, such as income, employment and bank account details, where relevant to a sale or purchase;
  • property details, including information about a property you are selling, buying or having appraised; and
  • details of your dealings and communications with us.

We only collect information by lawful and fair means. Information is held in hard copy and/or electronically, including within our CRM system.

Anonymity and pseudonymity
Where reasonable and practicable, you may deal with us anonymously or under a pseudonym — for example, when making a general enquiry about a property. However, this is not usually possible where we are legally required to identify you, or where identification is necessary to enter into a contract with us — for example, when signing a sale contract or listing authority, or where legislation requires us to verify your identity (such as for trust account or anti-money laundering purposes).

PART 2 — COLLECTION OF PERSONAL INFORMATION

Collection of solicited information

We will only collect personal information from you where it is reasonably necessary for our real estate functions or activities, or an activity you would reasonably expect. We generally collect information directly from you, through listing agreements, sale contracts, our website, and other forms you complete when dealing with us.

We may also collect personal information from other sources where appropriate and lawful, including:

  • online listing portals such as realestate.com.au and Domain, when you enquire about a property; and
  • publicly available sources, such as land title or council records, where relevant to a property transaction.

We will generally not collect sensitive information about you unless it is reasonably necessary for our functions and you have consented, or the collection is otherwise permitted or required by law.

Our website may use cookies to analyse website traffic and improve the visitor experience. A cookie is a small text file downloaded to your device when you access our website, which may record information such as your IP address and pages visited. You can configure your browser to reject cookies, though this may affect website functionality.

Dealing with unsolicited personal information
If we receive personal information about you that we did not solicit, we will determine within a reasonable period whether we could have collected it under APP 3. If so, we may use and hold that information as if we had collected it in the ordinary way. If not, and where it is lawful and reasonable to do so, we will destroy or de-identify the information as soon as practicable.

Notification of collection
When we collect personal information about you, we will take reasonable steps to notify you (at or before collection, or as soon as practicable after) of why we are collecting it, particularly where we collect the information from someone other than you — for example, a solicitor or conveyancer acting on your behalf.

PART 3 — USE AND DISCLOSURE OF PERSONAL INFORMATION

Use or disclosure of information
We collect personal information for a specific, primary purpose connected with our real estate services. We will not use or disclose your information for an unrelated secondary purpose unless you consent, or you would reasonably expect us to use or disclose it for that related purpose.

We may disclose your personal information to:

  • prospective purchasers, and their representatives, in connection with a sale (for example, sharing an offer with a vendor);
  • vendors, in connection with the sale of their property;
  • solicitors, conveyancers, banks, financial institutions and other parties involved in a transaction;
  • government or regulatory bodies, where required or authorised by law; and
  • our Service Providers, described below.

We use Service Providers to support our business, including but not limited to:

  • Reapit — our sales CRM, used to store client, property and enquiry records;
  • realestate.com.au and Domain — online listing portals, to which we upload property and enquiry information in order to advertise and manage enquiries about listed properties; and
  • Campaign Agent — used to administer vendor-funded marketing campaigns and collect marketing fund contributions.

These Service Providers may need to access your personal information to provide their services to us and may store information on servers located in Australia or overseas. We take reasonable steps to ensure our Service Providers handle personal information in a manner consistent with the APPs.

We do not sell your personal information, and we do not disclose it to third parties for purposes unrelated to the real estate services we provide, except as set out in this Policy or as required by law.

Direct marketing
We may use your personal information to send you information about properties, market updates or services that we reasonably believe may be of interest to you, where you would reasonably expect this or have consented. Every direct marketing communication will include a simple way for you to opt out of receiving further communications, and we will action any such request promptly and at no charge.

Cross-border disclosure of information
Some of our Service Providers, including those supporting our CRM, listing and marketing functions, may store or process personal information on servers located outside Australia. Where this occurs, we take reasonable steps to ensure that any overseas recipient handles your information consistently with the APPs, or that another exception under the Act applies (for example, your consent).

Government related identifiers
We do not generally use government related identifiers (such as a Medicare or driver’s licence number) other than to verify your identity where required by law or as part of a property sale.

PART 4 — INTEGRITY OF PERSONAL INFORMATION

Quality of information
We take reasonable steps to ensure the personal information we collect, use and hold is accurate, up to date, complete and relevant to the purpose for which it is used. Where you provide information to us directly, we rely on you to ensure it is accurate.

Security of information
We take reasonable steps to protect personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. This includes secure storage of physical files, access controls on our CRM and IT systems, and requiring our Service Providers to take appropriate security measures.
Where we no longer need personal information, we will take reasonable steps to destroy or de-identify it, unless we are required by law (including trust account, agency or tax record-keeping obligations) to retain it for a set period. For example, we retain copies of sale contracts and trust account records in accordance with applicable real estate legislation.

PART 5 — ACCESS TO, AND CORRECTION OF, INFORMATION

Access to information
You may request access to the personal information we hold about you by contacting our Privacy Officer using the details below. We may need to verify your identity before providing access. We will generally provide access within a reasonable time, unless an exception under the Act applies (for example, where giving access would be unlawful or would prejudice an enforcement activity). We may charge a reasonable fee for giving access, but not for making the request.

Correction of information
If you believe information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it. We will take reasonable steps to correct the information, and, where we have disclosed it to a third party, to notify that party of the correction, unless it is impracticable or unlawful to do so. If we refuse to correct information, we will provide written reasons and information about how you can complain, and, on request, will attach a statement from you noting your disagreement to the information held.

We will not charge you for making a correction request or for correcting information.
